CLEAREDMIND TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

Welcome to ClearedMind! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Cleared Mind (Pty) Ltd (registration number 2020/187373/07) ("ClearedMind," "we," "us," or "our"). By accessing or using ClearedMind's website, mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

2. DESCRIPTION OF SERVICES

2.1 What ClearedMind Provides

ClearedMind is a digital mental wellness platform offering:

  • Mental health screening tools (PHQ-9, GAD-7, PSS-10, and proprietary assessments)
  • Mood tracking and progress monitoring
  • Guided wellness activities (meditation, breathing exercises, journaling)
  • Educational resources and articles
  • Access to HPCSA-registered therapists for consultations
  • Music and video library for relaxation and sleep
  • Community support forums
  • Crisis resource directory

2.2 What ClearedMind Is NOT

IMPORTANT: ClearedMind is NOT:

  • A substitute for professional mental health treatment
  • An emergency or crisis intervention service
  • A diagnostic tool (only licensed professionals can diagnose)
  • Supervised by mental health professionals in real-time
  • Appropriate for managing mental health emergencies IF YOU ARE EXPERIENCING A MENTAL HEALTH CRISIS OR HAVING THOUGHTS OF HARMING YOURSELF OR OTHERS, DO NOT USE THIS PLATFORM. CALL the Suicide Crisis Helpline (0800 567 567), LifeLine (0861 322 322), or Emergency Services (112) IMMEDIATELY.

2.3 Service Availability

  • Services are provided "as is" and "as available"
  • We do not guarantee uninterrupted or error-free operation
  • We may modify, suspend, or discontinue features with or without notice
  • Platform maintenance may cause temporary unavailability

3. ELIGIBILITY & ACCOUNT REGISTRATION

3.1 Age Requirements

  • You must be at least 16 years old to use ClearedMind
  • Users aged 16-17 require parental or guardian consent
  • We do not knowingly collect information from users under 13

3.2 Account Creation

To use certain features, you must create an account by providing:

  • Accurate and complete registration information
  • A valid email address
  • A secure password
  • Date of birth for age verification

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access We are NOT liable for losses arising from unauthorized use of your account.

3.4 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You provide false or misleading information
  • Your account is inactive for more than 24 months
  • We suspect fraudulent activity
  • Required by law

4. SUBSCRIPTION PLANS & PRICING

4.1 Free Plan

The Free Plan includes:

  • 1 mental health screening per week
  • Basic mood tracking
  • 5 guided activities per month
  • Access to limited resources
  • Crisis resource directory
  • Community forum access

4.2 Premium Plan

The Premium Plan includes:

  • All Free Plan features
  • Unlimited mental health screenings
  • Advanced mood tracking with AI insights
  • Unlimited guided activities
  • 1 included therapist consultation per month (45 minutes)
  • Additional therapy sessions at discounted rates (R400/session)
  • Detailed, shareable progress reports
  • Ad-free experience
  • Priority support Pricing:
  • Monthly: R149/month
  • Annual: R1,490/year (save 17%)

4.3 Free Trial

  • New Premium subscribers receive a 7-day free trial
  • No credit card required during trial
  • Trial automatically ends after 7 days unless you subscribe
  • One trial per email address
  • We reserve the right to modify or discontinue trial offers

4.4 Payment Terms

Payment Methods:

  • Credit/debit cards via PayFast
  • Instant EFT
  • SnapScan, Zapper, and other PayFast-supported methods Billing:
  • Monthly subscriptions: Billed on the same day each month
  • Annual subscriptions: Billed once per year
  • All prices in South African Rand (ZAR)
  • Prices include VAT where applicable Auto-Renewal:
  • Subscriptions automatically renew unless cancelled
  • You'll be notified 7 days before renewal
  • Cancel anytime from Account Settings or by emailing support@clearedmind.com

4.5 Price Changes

  • We may change subscription prices with 30 days' notice
  • Price changes do not affect current billing cycles
  • Continued use after price change constitutes acceptance

4.6 Refund Policy

30-Day Money-Back Guarantee:

  • First-time Premium subscribers can request a full refund within 30 days of initial payment
  • No questions asked
  • Refunds processed within 5-7 business days After 30 Days:
  • No refunds for renewal payments
  • Exception: Technical issues preventing service access (contact support@clearedmind.com) App Store Purchases:
  • Purchases through Apple App Store or Google Play Store are subject to their respective refund policies

5. USER CONDUCT & PROHIBITED ACTIVITIES

5.1 Acceptable Use

You agree to use ClearedMind for lawful purposes only and in accordance with these Terms.

5.2 Prohibited Activities

You may NOT: Account Misuse:

  • Create multiple accounts to abuse free trials
  • Share your account with others
  • Provide false information during registration
  • Impersonate another person or entity Content Violations:
  • Post harmful, abusive, or harassing content in community forums
  • Share content that promotes violence, self-harm, or suicide
  • Post sexually explicit or pornographic material
  • Share spam, advertising, or commercial solicitations
  • Upload viruses, malware, or malicious code Platform Abuse:
  • Attempt to hack, disrupt, or gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) without permission
  • Reverse engineer or decompile our software
  • Remove or circumvent security features
  • Interfere with other users' access to the Services Intellectual Property Violations:
  • Copy, reproduce, or distribute our content without permission
  • Use our trademarks, logos, or branding without authorization
  • Create derivative works from our platform Therapist Abuse:
  • Harass, threaten, or abuse therapists
  • No-show repeatedly without cancellation
  • Request services outside therapists' scope of practice
  • Attempt to contact therapists outside the platform Legal Violations:
  • Use Services for any illegal activity
  • Violate South African laws or regulations
  • Infringe on others' rights (privacy, intellectual property, etc.)

5.3 Consequences of Violations

Violations may result in:

  • Warning or suspension of account
  • Permanent account termination
  • Removal of content
  • Legal action if necessary
  • Reporting to law enforcement

6. INTELLECTUAL PROPERTY RIGHTS

6.1 ClearedMind Ownership

All content, features, and functionality of the Services are owned by ClearedMind and protected by:

  • Copyright
  • Trademark
  • Patent
  • Trade secret
  • Other intellectual property laws This includes:
  • Website and app design
  • Assessment tools and algorithms
  • Logos, branding, and graphics
  • Text, images, videos, and audio
  • Software code and architecture

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Services for personal, non-commercial purposes
  • Download content for personal use only (where permitted) You may NOT:
  • Reproduce, distribute, or publicly display our content
  • Create derivative works
  • Use for commercial purposes
  • Remove copyright or proprietary notices

6.3 User-Generated Content

Content You Create: When you post content on ClearedMind (forum posts, reviews, testimonials), you retain ownership but grant us a worldwide, royalty-free license to:

  • Display, reproduce, and distribute your content on our platform
  • Use for marketing purposes (with your explicit consent for testimonials)
  • Moderate, edit, or remove content that violates these Terms You represent that:
  • You own or have rights to the content you post
  • Your content does not violate others' rights or laws
  • You consent to ClearedMind using your content as described

6.4 Feedback

If you provide feedback, suggestions, or ideas about our Services:

  • We may use them without obligation or compensation to you
  • You waive any intellectual property claims
  • We are not required to implement your suggestions

6.5 Third-Party Content

Some content (licensed music, videos, screening tools) is owned by third parties. You must comply with their license terms.

7. SCREENING TOOLS & ASSESSMENTS

7.1 Nature of Assessments

Our screening tools:

  • Are self-report instruments for educational purposes
  • Help identify symptoms but do NOT diagnose conditions
  • Should NOT be used as the sole basis for treatment decisions
  • Are NOT a substitute for professional clinical assessment

7.2 Licensed Tools

PHQ-9, GAD-7, and PSS-10 are public domain tools used under appropriate licensing:

  • Free to use per phqscreeners.com guidelines
  • Used in accordance with published scoring instructions
  • Validated for screening purposes, not diagnosis

7.3 Results Interpretation

  • Results are provided with general guidance only
  • Always discuss results with a qualified healthcare provider
  • Scores may be affected by various factors (mood, understanding, cultural context)
  • Retake assessments regularly for accurate progress tracking

7.4 Crisis Triggers

If your responses indicate suicidal thoughts or severe symptoms:

  • You'll receive immediate crisis resources
  • We may contact emergency services if necessary for your safety
  • This is for your protection and overrides normal confidentiality

8. THERAPIST SERVICES

8.1 Therapist Relationship

Independent Contractors:

  • Therapists on ClearedMind are independent contractors, NOT employees
  • Each therapist maintains professional responsibility for their services
  • ClearedMind facilitates bookings but does not supervise clinical care HPCSA Registration:
  • All therapists are registered with the Health Professions Council of South Africa (HPCSA)
  • All hold professional indemnity insurance
  • All comply with HPCSA ethical guidelines

8.2 Booking & Cancellation

Booking Process:

  • Browse therapist profiles
  • Select a therapist and available time slot
  • Complete intake questionnaire
  • Make payment via PayFast
  • Receive confirmation and session details Cancellation Policy:
  • More than 24 hours before session: Full refund
  • Less than 24 hours before session: 50% charge
  • No-show: Full charge
  • Therapists may also cancel with 48 hours' notice (full refund issued)

8.3 Therapist Fees

  • Therapists set their own session fees (typically R600-R2,000 per 45-minute session)
  • Premium members receive discounted rates
  • Additional sessions beyond included Premium session: R400/session
  • Payment processed through ClearedMind platform

8.4 Session Conduct

Your Responsibilities:

  • Join sessions on time
  • Ensure stable internet connection
  • Use private, quiet setting
  • Engage honestly and respectfully
  • Follow therapist's recommendations Therapist Responsibilities:
  • Provide professional, ethical services
  • Maintain confidentiality per HPCSA guidelines
  • Conduct sessions as scheduled
  • Keep clinical notes per professional standards

8.5 Limits of Therapy Services

Therapy via ClearedMind:

  • Is conducted via video or phone
  • Is appropriate for many mental health concerns
  • May not be suitable for severe or crisis situations
  • Should be discussed with your therapist to ensure appropriateness Not Appropriate For:
  • Active psychosis
  • Severe substance abuse requiring medical detox
  • Immediate safety concerns
  • Court-ordered therapy (unless therapist agrees)

9.1 Privacy Policy
